1. About this policy

GI Asia Pacific Pty Ltd (GI Asia Pacific, we, us, our) is an Australian investment company and venture builder. We respect your privacy and are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

This policy explains how we collect, hold, use and disclose personal information through our website at giasiapacific.com and in the course of our business, and how you can access, correct or complain about our handling of it.

This policy does not cover the websites or operations of the companies in our portfolio, each of which maintains its own privacy policy.

2. What personal information we collect

We collect only the information we reasonably need.

Information you give us directly

  • Name, job title and the organisation you represent
  • Business email address, telephone number and country
  • Your organisation's website and sector
  • The content of enquiries, correspondence and meeting notes
  • Information you provide in the course of an engagement

Information collected automatically

  • IP address, browser type, device and operating system
  • Pages visited, referring website and time of visit
  • Information collected through cookies and similar technologies

You do not need to provide personal information to browse this website. If you choose not to provide the information requested in our enquiry form, we may be unable to respond to your enquiry.

3. Sensitive and health information

We do not collect sensitive information — including health information — through this website.

Under the Privacy Act, "sensitive information" includes health information, genetic and biometric information, racial or ethnic origin, political opinions, religious beliefs, sexual orientation and criminal record. Sensitive information attracts higher protection and generally requires your consent before it can be collected.

GI Asia Pacific is not a health service provider and does not provide clinical services. Where we are engaged by a client operating in the health, biotechnology or medical technology sector, any handling of health information or other sensitive information is governed by a separate written engagement agreement, and is undertaken:

  • only with the consent of the individuals concerned or as otherwise permitted by law;
  • only where reasonably necessary for the agreed purpose;
  • in accordance with the Privacy Act, the APPs and any applicable State or Territory health records legislation, including the Health Records Act 2001 (Vic) and the Health Records and Information Privacy Act 2002 (NSW); and
  • under confidentiality and data-handling terms agreed in advance with the client.

Please do not send us health information, patient data, clinical records or other sensitive information through the enquiry form or by unsecured email. If an engagement requires the exchange of such information, we will agree a secure method with you first.

4. How we use personal information

We use personal information to:

  • respond to your enquiry and arrange a meeting or call;
  • assess whether we are an appropriate fit for your requirements;
  • provide, manage and deliver our services;
  • communicate with you about an engagement or matters you have asked us about;
  • maintain our business records and manage our relationships;
  • improve our website and services; and
  • comply with our legal and regulatory obligations.

Marketing

We may occasionally send you information about our services where you have consented or where you would reasonably expect it given your enquiry. Every such message will identify us and include an unsubscribe facility, consistent with the Spam Act 2003 (Cth). You can opt out at any time using the unsubscribe link or by contacting us.

We do not sell personal information. We do not use personal information for automated decision-making that produces legal or similarly significant effects.

5. Disclosure of personal information

We may disclose personal information to:

  • our directors, employees and contractors, on a need-to-know basis;
  • professional advisers — legal, accounting, tax and regulatory — engaged by us or on your behalf in connection with a matter;
  • service providers who support our operations, including website hosting, email, file storage and scheduling tools;
  • a party to whom you have asked or authorised us to make an introduction; and
  • any person where required or authorised by law.

Where we introduce you to a third party — for example a distributor, professional adviser or potential partner — we will do so only with your knowledge.

We treat the content of client and prospective client enquiries as confidential. Information you provide about your business, plans or commercial position is not shared outside GI Asia Pacific except as set out above or with your consent.

6. Overseas disclosure

Some of our service providers store or process information outside Australia. In particular:

  • our website is hosted by Netlify, Inc., which stores data in the United States;
  • our email and document storage providers may store data in the United States and other jurisdictions;
  • our portfolio operations extend to Thailand, Singapore and Vietnam, and information may be disclosed to those operations where relevant to a matter.

Before disclosing personal information overseas, we take reasonable steps to ensure the recipient handles it in a manner consistent with the APPs, or we obtain your consent.

7. Security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These include access controls, encrypted transmission, reputable service providers and restricting access to those who need it.

No method of transmission over the internet is completely secure. Information you send us by email or through our website is sent at your own risk.

We retain personal information only for as long as we need it for the purposes described in this policy, or as required by law. When it is no longer needed, we take reasonable steps to destroy or de-identify it.

If we suffer a data breach likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme.

8. Access, correction and complaints

Access and correction

You may request access to the personal information we hold about you, or ask us to correct it, by contacting us at the address below. We will respond within a reasonable period, normally 30 days. We may need to verify your identity. In limited circumstances permitted by the Privacy Act we may decline a request; if we do, we will explain why in writing.

Anonymity

Where lawful and practicable, you may deal with us anonymously or under a pseudonym. In most cases we will need your name and contact details in order to respond usefully.

Complaints

If you believe we have breached the APPs, please contact us first. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days.

9. Cookies and analytics

Our website uses cookies and similar technologies to operate the site and understand how it is used. Cookies are small files stored on your device.
